ISLAMABAD - The Supreme Court on Monday directed the federal government to make efforts for the recovery of missing person Akhunzada.
A division bench headed by Justice Jawwad S Khawaja and comprising Justice Ejaz Afzal was hearing the cases of three missing persons.
About Pervaiz Ahmed, police informed the bench that they were investigating the matter, but sought three weeks time. Expressing satisfaction over the report the judge said if the police had made sincere efforts earlier then Pervez would have been recovered.
Adjourning his case for three weeks, Justice Jawwad remarked that if efforts were made then the missing persons could be recovered, but it seemed instead of practical steps the law enforcement agencies satisfied with filing of reports.
During the proceeding, Khawar Mehmood, who have been recovered recently appeared before the court and upon the confirmation of his wife Sadia Bibi the court disposed of his case.
Regarding Akhunzada, missing person’s case, Additional Attorney General Shah Khawar and Additional Advocate General Khyber Pukhtookhawa Zahid Latif Qureshi appeared before the court.
The AAG KPK informed the court that the search for Akhunzada was going on in the internment centres, set up in the province. He, however, told that they doubt he could be in internment centres of FATA, adding the tribal areas were under the control of the federation.
The AAG KPK read out the statement of Akhunzada’s brother Hafiz Muhammad Ramzan. According to that a few persons in plainclothes picked up his brother and handed over to him to army personnel. Upon that Justice Jawwad inquired why an FIR has not been registered so far.
Zahid Qureshi told that FIR could not be registered as the tribal areas were not under the jurisdiction of Khyber Pakhtunkhawa. Justice Ejaz Afzal remarked that the under law Political Agents manage the affairs in FATA then why the FIR was not registered.
Shah Khawar informed that Additional Attorney General Tariq Khokhar was looking after the missing person cases, but now he has been transferred, adding now he would take care of missing person cases. He requested the court to give him little time in order to check the status of the case.
After the break when the hearing resumed, Shah Khawar informed that according to the law DCO Tank was empowered to order for the registration of FIR. He said the Secretary FATA would contact the Secretary KPK in this regard therefore one week time be granted for submitted report in this regard.
The court therefore adjourned the hearing of the case till 5th March.
