ISLAMABAD - The Islamabad High Court (IHC) Monday ordered to register a case against ARY channel on a petition in which the petitioner has alleged blasphemy of Ahle Bait (R.A) by the said TV channel in its morning show.
In this connection, Chief Justice (CJ) IHC Justice Muhammad Anwar Khan Kasi accepted the petition moved by District Bar Association (DBA) Islamabad Naseer Ahmad Kayani.
Previously on June 10, the Chief Justice IHC had issued notices to the SHO Margallah who had not registered the FIR against TV channel despite an application filed by the petitioner Kayani.
The petitioner alongside another lawyer Rao Abdur Raheem has also assailed an order of the additional session judge who accepted the application of FIR against Geo Television but rejected the application for registration of FIR against ARY television declaring it not cognizable and non-maintainable.
A standing counsel Raja Khalid Awan said that the FIR was registered against a TV channel who aired a Manqabat and in the same case another TV channel was treated otherwise who repeatedly aired the same contents.
The petitioner has contended before the court that the ASJ in the matter of an applicant Arshad Mehmood Butt had ordered for registration of FIR on May 17 against the Geo television for allegedly airing blasphemous contents.
The petitioner has contended before the IHC that the order of ASJ is illegal, unlawful and result of misreading and non-reading of the contents of the petitioner's application.
He added that ASJ has ignored that under section 154 if the contents of the application/information disclose the commission of cognizable offence, the police is duty bound to register the FIR.
Therefore, he prayed to the court to order registration of FIR against the ARY TV channel and against all those who participated in the preparation of the said programme.
