ISLAMABAD - The Supreme Court on Tuesday ordered the intelligence agencies to inform the court who had murdered Masood Janjua, when and where he was murdered and where his dead body was.
Justice Jawwad S Khawaja gave these remarks while presiding over a three-member bench of the apex court during hearing of Masood Janjua missing person case.
"Statement of former chief of intelligence agency Nusrat Naeem is not scripture that it be accepted as it is. Punjab government if thinks ISI is out of its jurisdiction, it should tell the court,” he further remarked.
The court rejected the plea of Punjab government for disposing of case on the grounds that Masood Janjua was killed being a double agent of US and Al-Qaeda.
“If ISI had information about Masood Janjua and Faisal Faraz why it did not know where was his dead body. His DNA test be got conducted and body be handed over to his wife,” the court remarked.  The court also sought affidavits of former senior officers of intelligence agency including Col (r) Habibullah, Lt-Gen (r) Shafqat Ahmad and Lt-Gen (r) Nadim Taj within 48 hours.
The court also sought first edition of Pervez Musharraf book In the Line of Fire wherein former president had disclosed that Pakistani citizens had been handed over to the US.
Additional Advocate General (AAG) Razzaq A Mirza took the plea in the court that Masood Janjua was killed in 2005. He was a double agent of US and Al-Qaeda and he was also wanted by Pakistani intelligence agencies. Al-Qaeda had killed him being double agent.
DPO Haroon Janjua told the court that Foreign Ministry had written a letter to UNHCR to obtain the statement of Dr Imran Munir but no reply had been received so far.
Additional Attorney General Tariq Khokhar also appeared before the court. Razzaq A Mirza said as per intelligence agencies Masood was no more in this world.
Justice Jawwad remarked, "If this man is not in this world then you will have to tell where is he”.
Justice Jawwad asked additional attorney general that he had conducted investigations under the excerpts of Pervez Musharraf book entitled In the Line of Fire".  “As per this book people were handed over to US in return for money. In the second edition all such things were deleted. Amina has been asking us for the last eight years about her husband. What should we reply her,” Justice Jawwad observed. He remarked, "They are citizens of federation and province. There are several straight things which should be investigated.
"If this man was a double agent then intelligence agencies should have a lot of information about him. We are going to summon the Brigadier about whom you are talking about and cross question him. We will give a decision after reviewing your reply. Razzaq Mirza said Nusrat Naeem, former DG ISI, had filed his reply before the commission that he was at the hit list of intelligence agencies.  Justice Jawwad remarked, "This is a concrete evidence that he was at the hit list of our agencies. This can be traced”.
Law officer from Punjab, reading out statement, said he had links with Tariq, a US agent, who had installed chips in laptop and sent to Al-Qaeda through Masood Janjua and Faisal Faraz due to which they were killed.
Justice Jawwad said, "When you know so much about him why don’t you tell us where his body is. Do you want to say that intelligence agency is out of your jurisdiction? Your everything is not divine scripture that it be accepted. General Sahib knows even about wagon but he does not know where he was buried”. The hearing of the case was adjourned till February 20.

A six-member foreign judicial delegation of USA headed by Morrison England, US District Court Judge from the eastern district of California, and comprising other delegates including Charles L Jenkins, Resident Legal Advisor and Jullia Fromholz, Rule of Law, Advisor, called on Chief Justice of Pakistan Tassaduq Hussain Jillani in Supreme Court building here on Tuesday.
The delegation discussed the matters of mutual interest relating to functioning of legal/judicial system in the two countries. The US judge stated that it is honour for him to meet the Chief Justice of Pakistan. He also appreciated his lordship’s role for dispensation of justice in country.
The delegation exchanged the views about Intellectual Property Law and its enforcement in Pakistan. The Chief Justice informed the delegation that judiciary in Pakistan is fully cognizant of intellectual property law matters and its importance for the economic development of the country. They also exchanged views for furthering the legal education in Pakistan by mutual cooperation between judiciaries of the both countries. At the end, the Chief Justice thanked the delegation and presented souvenir to delegation as token of respect and gesture of goodwill. The delegation also thanked the Chief Justice for sparing time for them.
