Government directed to provide legal aid to Dr Aafia

KARACHI - Sindh High Court (SHC) on Friday directed the government to provide legal assistance to the detained Pakistani citizen, Dr Aafia Siddiqui, in US prison. The court disposed of three petitions about bringing her back to the country. The division bench of the SHC comprising Justice Muhammad Athar Saeed and Justice Arshad Siraj Memon issued the directions over three different constitutional petitions moved by Human Right Networks Advocate Intikhab Alam Suri, Awami Muslim League leader Mahfoozyar Khan and Nisar A Mujahid. The court further ordered to present the report within 45 days about the two missing children of Dr Aafia and directed the agencies to take action in this regard. However, if the order was not complied, then the petitioner could file contempt of court petition against the government. The court ordered that the government should hire the services of a US legal expert through its embassy, who would provide legal assistance to Dr Aafia by considering legal aspects of the case. The court further ordered that if Dr Aafias family needed financial assistance for fighting legal war, then it would be also provided to them. Petition against ZAB's death sentence dismissed The SHC on Friday dismissed a constitutional petition seeking probe into the 'judicial murder of former premier Zulfiqar Ali Bhutto. The petition was moved by Sohail Hameed advocate. The division bench comprised of Justice Athar Saeed and Justice Arshad Siraj Memon. The bench asked the petitioner to further move to Supreme Court as the high court could not conduct hearings over the petition against the decision of the apex court. The plaintiff challenged the death sentence of ZA Bhutto while seeking probe over the courts verdict as well as dismissal of the review petition by the apex court against his (Bhutto) death sentence. The plaintiff submitted that the judgement in ZABs case (criminal appeal in 1978) was pronounced on March 18, 1978 in the charges of criminal conspiracy. Through a split decision, Bhutto was sentenced to death not on the basis of facts, but law. However, he was sentenced as the law and principles of law were twisted and misinterpreted. The plaintiff prayed that the interior ministry should be directed in registering an FIR against those who were involved in the conspiracy against Bhutto in overthrowing his elected government and then later conspired for his judicial murder. Another division bench of SHC comprising of Justice Gulzar Ahmed and Justice Malik Mohammad Aqil adjourned the hearing over the petition moved by Taluka Nazim Larkana Qurban Ali against his suspension till May 15. Advocate General Sindh, Yousuf Leghari, appeared before the bench to submit his comments by representing the state. He requested to form a full bench court to conduct the hearing. The Taluka Nazim had moved to the court against his suspension by Sindh government, while submitted that the provincial government had violated the rule by suspending him. The petitioner made respondent to chief minister Sindh, Secretary Local Bodies, DG Anti Corruption and other authorities concerned. The bench issued notice to attorney general Sindh, asking about the legal authority of the CM in the constitution to suspend taluka nazim from his post.
