SHC allows formrt minister Altaf Unar to travel abroad

KARACHI (PPI) - Sindh High Court Monday allowed ailing former PML-Q Sindh Minister Haji Altaf Unnar to travel abroad. Unar challenged placement of his name on Exit Control List in SHC, submitting he suffered from kidney disorders & obtained Indian visa for kidney transplantation at Bombay. But, Interior Ministry placed his name on ECL without prior notice. His condition was deteriorating due to restriction on his movement, while visa would also lapse. He prayed to direct Interior Ministry to immediately remove his name from ECL. SHC division bench comprising Justice Mushir Alam & Justice Muhammad Afzal Soomro allowed petition and permitted him to travel abroad. notice to DAG in forex scam case Sindh High Court Monday issued notices for June 17, 2009 to Deputy Attorney General on bail applications filed by Muhammad Hanif Kalia, Abdul Munaf Kalia & Javed Khanani in alleged forex scam case. Applicants, directors of Khanani & Kalia International, filed applications in SHC through Advocate Shaukat Hayat. Federal Investigation Agency arrested applicants in November 2008 in money laundering case. According to prosecution, accused transferred billions of rupees abroad illegally. Cases under Foreign Exchange Regulation Act 1947, Prevention of Electronic Crimes Ordinance 2007 & Pakistan Penal Code were lodged against them at FIA Crime Circle, Karachi & Lahore in 2008. Counsel submitted challan in cases was already submitted in trial court, therefore, applicants may be granted post arrest bails. Police directed to produce girl Sindh High Court Monday directed police to produce a girl, detained by parents for marrying on her own choice, in court on June 22, 2009. Hooran on June 22, 2009. notice issued in cellular phone tower case Sindh High Court Monday repeated notice to M/s Pakistan Mobiles Ltd on unauthorised installation of cellular phone tower in Fatima Jinnah Colony, Karachi. Residents of Paradise Apartments instituted lawsuit, submitting installation of towers was prohibited in territorial jurisdictions of DHA, but defendant M/s Pakistan Mobiles Ltd erected cellular tower on penthouse owned by Muhammad Hamid atop residential plaza. Rays emitted by towers were causing serious hazards to life of 38 families residing in plaza, but KBCA took no action despite notices. They prayed to direct defendants remove mobile tower. Justice Ms Yasmin Abbasey ordered to repeat notice to defendants for July 03, 2009 to file comments. notices issued to Transport Secretary Sindh High Court Monday issued notice to Sindh Secretary Transport, Chairman Provincial Transport Authority & others on withdrawal of powers from Sindh Bus Owners Cooperative Society to make financial compensation to heirs of road accident victims. Societys Secretary Raj Kumar moved SHC through Advocate Mehmood Habibullah, submitting Sindh Law Department issuing extraordinary gazette notification in 1972, conferred empowered plaintiff society to collect compensation money from bus owners & make it legal heirs of people killed or injured in road accidents across province. In September 2008, Sindh Transport Minister summoned Society office bearers along with up to date details of compensation made to victim families since August 2001. He again called them, seeking more details. Transport Minister in May 2009 withdrew powers from society to collect, make compensation to victim families by suspending notification of 1972 without prior notice. Order was yet to be communicated to plaintiff society. Counsel stated since Sindh Bus Owners Cooperative Society worked under Sindh Cooperative Societies Act 1925, Provincial Minister had no powers to interfere with its matters. He prayed to declare notification was still operative and Provincial Minister had no powers to interfere in plaintiffs matters.
