SA authorises CM to appoint SPSC Chairman

KARACHI - The newly-elected Sindh assembly in its first session on Wednesday completed the whole agenda of the day within 90 minutes with opposition playing as promised positive role. The agenda carried five ordinances, which the law minister laid before the assembly, introduction and consideration of government bill No-1 of 2008-The Sindh Public Service Commission (Amendment) Bill, 2008, laying of reports of the Auditor General of Pakistan on the accounts of government of Sindh for the year 2003-04. The house was prorogued after carrying out the agenda except for last item-constitution of the Standing Committees and other committees as laid down in the rules. The treasury benches and the opposition showed harmony in carrying out the agenda which also included what was considered the thorny issue of appointment of Chairman Sindh Public Service Commission (SPSC). Sindh Minister for Law and Parliamentary Affairs Ayaz Soomro introduced the Sindh Public Service Commission (Amendment) Bill No 01 of 200, through a motion. Syed Sardar Ahmed Parliamentary Part leader of MQM in Sindh Assembly raised the objection on the proposed amendment. Syed Sardar, a former top bureaucrat of the province, while raising his objection asked the treasury benches not to amend clause 4 of the bill because he argued it had legal complications and the bill may be referred to the select committee of the house for examination. The amendment was aimed at nullifying the notification issued by the caretaker Chief Minister who had appointed former federal secretary Javed Ashraf Hussain in place of former-chairman Mohammed Hassan Bhutto, as head of the SPSC, 30 days before the expiry of the official tenure of Mr. Bhutto. Under the amendment the members of the Board would also be reconstituted. It may be mentioned here that during Ali Mohammad Maher's regime as chief minister, a bill was forwarded to the governor for his assent to change the status quo and give these powers to the Chief Ministe, but it was returned for "review." Senior Sindh Minister Pir Mazharul Haq had argued that the notification had malafide intentions as it was issued after the Feb 18 elections were held. By making an amendment the treasury benches wanted to rectify the wrong. It was the prerogative of the newly elected Chief Minister to make the appointment, he said. Syed Sardar Ahmed asked the treasury benches to avoid any legal ramifications, it was better to substitute the name so that the chief minister comes back in the rule. But if you insist on amendment it may cause legal problems, he added. Treasury members Haji Munawwar Ali Abbasi, Rafique Engineer and Murad Ali Shah supported the bill and termed it as positive and welcome step. However, after arguments and counter argument, the chair put the motion in the house which carried unanimous. The law minister readout the bill clause by clause and the bill was passed into law. Earlier, when the house came to order at about 5-05 PM  65 minutes behind scheduled time, opposition members including Syed Sardar Ahmed, Syed Shoaib Bukhari, Adil Siddiqui, Faisal Sabzwari, Bilqees Mukhtar of MQM, Arif Mustafa Jatoi of NPP, Jam Madad Ali of PML (F) felicitated Nisar Ahmed Khuhro on his unopposed election of Speaker and Syed Qaim Ali Shah on his unopposed election of Chief Minister Syed Qaim Ali Shah. They said that they were not present on that day so they were offering their hearty felicitation. They assured the treasury benches their full cooperation in carrying out business for the welfare and well beings of the people of Sindh. The MQM members said that they always supported NFC Award, Kalabagh Dam and provincial autonomy. They said that they will continue to support the steps of the incumbent government for the betterment of the masses. Responding to the felicitation of the opposition members, Sindh Chief Minister Syed Qaim Ali Shah expressed his personal gratitude to the members of the MQM, NPP and PML (F) and termed it as a good beginning. He said that that his government did not believe in politics of vendetta and vengeance. Mr. Shah said that the treasury would welcome the any positive suggestions from the opposition for the prosperity of the people of Sindh. If they pinpointed any problem or situation which needed to be rectified or removed in the best interests of the province and the country, "we certainly would welcome it", he added. Syed Qaim Ali Shah said whatever happened in the past should be set aside or forgotten and a new beginning should be made. The assembly should work for the development of the province because it was needed for the welfare of the people of Sindh.  Earlier, Mir Hassan Khoso of PPP and Ms Heer Soho of MQM took oath. Fateha was offered for the soul of journalist Khadim Hussain, who was murdered recently in Hub district of Balochistan. A private TV channel reported: The Sindh Assembly has taken back the authority of appointing the Chairman Sindh Public Service Commission from the provincial governor and assigned it to the chief minister.  Sindh Minister for Law and Parliamentary Affairs Ayaz Soomro introduced the Sindh Public Service Commission (Amendment) Bill No 2008 through a motion.
