SHC seeks comments in affectees compensation case

KARACHI (PPI) - A division bench of Sindh High Court comprising Justice Mushir Alam & Justice Muhammad Athar Saeed Wednesday issued notice to City District Government Karachi Principal Law Officer over alleged non-payment of compensation to affectees of Lyari Expressway Project, Karachi. Petitioners Abdul Rashid along with 16 other affectees moved SHC to seek payment of compensation amount by CDGK. They submitted their houses in Pak Sarhad Colony & Bhangoria Goth, Gulberg Town were demolished for construction of Lyari Expressway by CDGK, which promised them monetary assistance or alternate land as compensation for lands acquired for project. A committee set up to resolve compensation matter heard 373 affectees, but demanded illegal gratification to issue Rs 50,000 compensation cheques. They prayed to direct CDGK to release cheques. SHC division bench after hearing arguments issued notice to CDGK Principal Law Officer Manzoor Ahmed to file comments in two weeks. SHC orders admitting of ailing UTP to hospital Justice Amir Hani Muslim of Sindh High Court Wednesday ordered jail authorities to shift ailing under trial prisoner to Civil Hospital Karachi for treatment. Applicant Muhammad Hafeez, facing trial in attempt to murder case at Malir District Jail Karachi, moved SHC to seek bail on medical grounds. His counsel Janroz Afridi submitted applicant suffered from burning maturation, retention of urine, hematuria blood in urine and needed medical treatment that were not available at prisons hospital. He prayed to grant him bail on medical grounds so that he could get treatment at any other hospital. Justice Amir Hani Muslim disposed of bail application with direction that UTP shall be admitted to Jail Ward of Civil Hospital Karachi and Medical Superintendent of hospital shall depute doctors, who are examining applicant shall submit report as to whether his stay there is required. SHC releases murder convict as parties compromise A division bench of Sindh High Court comprising Justice Mushir Alam & Justice Muhammad Athar Saeed Wednesday ordered release of a murder convict as family of deceased compromised matter on payment of compensation. According to prosecution, Muhammad Aslam & Muhammad Rafique killed a woman, Sakina, mother of two, in limits of Gharo police station in year 2000. They were convicted & awarded life imprisonment, ordered to pay Rs 560,000 as Diyat to legal heirs of victim. They sought to set aside sentences as relatives of deceased compromised matter, but SHC on August 9, 2009 directed appellant, Aslam, to deposit Rs 140,000 as his share out of total compensation amount with SHC Nazir. Their counsel Kazi Ashraf submitted appellant Aslam had deposited amount of his share and prayed to order his release as per compromise. Deceaseds husband, Afzal Asad, conceded that he gave up right of Diyat, but amount of compensation was paid by appellant in scheme of minor legal heirs Khurrum Asad & Asadullah Asad. Court order said - Appellants were convicted to three years imprisonment US 452, pay fine Rs 1000, ten years rigorous imprisonment US 459 & ten years rigorous imprisonment US 460 PPC. Aslam was convicted US 302(b) PPC to run concurrently & have settled compromise US 345(6) CrPC. Appellant, arrested on December 19, 2000, is to be released forthwith, if not required in any case.
