Pre-arrest bail of main accused confirmed

KARACHI - Sindh High Court Tuesday confirmed pre-arrest bail earlier granted to chieftain of Solangi tribe Ali Sain Dad Solangi allegedly involved in throwing 17-year-old girl to dogs over Karo Kari charge. Tasleem Solangi, 8-month pregnant, was forced to give birth prematurely and then thrown in front of hungry dogs allegedly by her father-in-law on March 7, 2008 at Hina Shah Village, Taluka Bara Masi Goth, District Khairpur. Chief Justice of Pakistan took suo moto notice of brutal killing on January 10, 2009 & ordered IG Police Sindh, others to investigate case. Following investigation, former SHO Ahmedpur police station, Shah Zaman Dahar & police constable Gul Bahar Panhwar were arrested on June 30, 2009 for allegedly misplacing articles to be used a evidence in case. Advocate Abdul Qadir Halepota submitted applicant Ali Sain Dad Solangi, a grade 20 officer of Sindh government, was accused of being member of Jirga that declared girl killed on Karo Kari pretext. In fact, Sain Dad supported written verdict of Jirga that allowed handing girl over to her father Gul Sher, but it could not be implemented. Counsel stated his client was falsely named accused despite he did not support killing of girl. He prayed to confirm bail before arrest earlier granted to his client. Additional Prosecutor General Salim Akhtar opposed plea. SHC single bench headed by Justice Arshad Siraj Memon after hearing arguments allowed application and confirmed pre arrest bail earlier granted to Ali Sain Dad Solangi. HEARING OF STPP WORKERS KILLING ADJOURNED Justice Maqbool Ahmed Awan of Sindh High Court Tuesday adjourned hearing of bail application of Sohrab Goth police station house officer Karachi till first week of September 2009. SHO Nasirul Hasan was booked over killing of two Sindh Taraqqi Pasand Party workers & granted interim bail by SHC single bench in sum of Rs200,000. He moved application, seeking confirmation of interim bail, but his counsel Shaukat Zubedi was on general adjournment. It was prayed to adjourn matter. Justice Maqbool Ahmed Awan adjourned hearing till first week of September 2009. According to prosecution, police allegedly opened fire on protest rally organised by STPP against arrival of internally displaced persons in Sindh and two protestors Hasan Magsi and Barat Kalmati were killed in firing on June 10, 2009 in Karachi. SP Gadap Town Iftikhar Lodhi, SHO PS Sohrab Goth Nasirul Hasan, SHO Gulshan-e-Maymat Amanullah & SHO Gadap City Malik Mazhar Iqbal were booked in FIR lodged at PS Sohrab Goth on July 3, 2009 on court order. Former SHO Gadap Malik Mzhar Iqbal is in judicial custody. COURT SUMMONS SPG IN BAIL CASE In another case, Justice Salman Ansari summoned Prosecutor General Sindh, seeking explanation over granting bail to the relatives of former MPA and others, till 28 July. The court heard the application moved by Mehmood Malkani requesting cancellation of bail plea of former MPA Azhar Kukario of PML-Q and others, due to life threats to the applicant and his family. In an application, submitted through his counsels, Abdul Wahab Baloch and Sartaj Ahmed Malkani, the petitioner said that in the general elections held in February 2008, he was the chief polling agent of Agha Siraj Durrai, Provincial Minister of Local Bodies. On the polling day, a nephew of former MPA and PML-Q leader Zulfiqar Kumario, named Azhar Kumario, along with eighteen companions, all armed with sophisticated weapons, reached the poling station Sangi No 53 in Shikarpur and started torturing him and his two sisters, who were also polling agents, in a bid to sabotage the polling process. He further submitted that the accused also attempted to kidnap his both sisters at gunpoint, but on the arrival of rangers, they managed to escape from the scene. Malkani maintained that he and his entire family were receiving life threats from the accused, who was granted bail on 27th June from the session court. He also submitted that culprits were influential persons and could hurt his family members if their bail was not cancelled. He pleaded to cancel the bail of the accused. SHC STAYS FARMHOUSE DEMOLITION Meanwhile, Justice Ms Sofia Latif issued notice to the higher ups of Karachi Building Control Authority (KBCA) seeking explanation regarding demolition of a farmhouse located in Gadap Town, till 6 August. The petitioner, Saeed Haroon, had submitted that he got a 10-acre plot in Gadap town, on a 30-year lease from the Board of Revenue and constructed a farmhouse on the land. But the KBCA officials wanted to demolish it by declaring it illegal, however, the said area did not fall under its jurisdiction. The court issued notice to the KBCA officials, and in the meantime also granted stay order over demolishing the farmhouse.
