'Heroin smuggler' bail plea admitted

KARACHI - The Sindh High Court on Monday admitted a bail plea moved by an alleged heroin smuggler Irfan Ahmed against a solvent surety of Rs200,000. SHC Justice Salman Ansari conducted the hearing over the bail plea submitted by the alleged accused. Shaukat Hayat advocate appeared before the court on behalf of the petitioner and submitted his comments. The accused Irfan had been arrested from Karachi Airport in 2008 in the charges of smuggling capsules which were allegedly recovered from his stomach, when he was about to leave for Kuala Lumpur. Earlier, the trial court had rejected his bail plea. The counsel for the applicant submitted that capsules were recovered on the fifth day of his arrest. There was no eyewitness to the alleged recovery and that no medical report regarding recovery was available on record. Only officials are the alleged witnesses in the case. It is a case of further inquiry as there is a discrepancy in the weight of the contra band recovered. After hearing his comments, the court granted him bail against a solvent surety of rupees 200,000. Meanwhile, a bench of SHC comprising of Justice Gulzar Ahmed issued notice to District Nazim of Jacobabad, Saeeda Soomro, and other respondents over the petition moved by Federal Health Minister Ejaz Hussein Jhakrani and Mir Ahmed Nawaz Jhakrani till February 25. Barrister Abid Zuberi appeared on behalf of the plaintiff. The plaintiff has submitted a suit worth Rs1,000 million moved by Federal Health Minister Ejaz Hussein Jhakrani and Mir Ahmed Nawaz Jhakrani against a number of respondents including District Nazim of Jacobabad, Saeeda Soomro, Maleeha Malik, Fahad Malik and others. The plaintiff submitted that Saeeda Soomro, along with other respondents have started political victimisation against him by issuing news items and editorial against him in various newspapers. After hearing the arguments from the council, court ordered issuance of notices to the respondents for February 25. Meanwhile, allowing a constitution petition filed by a man who lost his son due to hazardous industrial waste. A division bench of SHC comprising of Justice Khilji Arif Hussain and Justice Arshad Noor Khan ordered the Managing Director of SITE (Sindh Industrial and Trading Estate) to ensure removal of waste and file a case against the concerned industrial unit who is held responsible. The bench earlier heard the counsel for petitioner, Khawaja Muhammad whose son had first lost his two limbs and later life after receiving burns of the acidic waste thrown in the most populous and poor slum area of Orangi Town, Karachi. A number of children had also sustained injuries due to this toxic waste. The bench also heard an official of the Environment Protection Agency (EPA) Sindh, who submitted before the bench that show cause notice has been issued to the Berger Paints Limited. The industrial unit has been directed to stop dumping the toxic waste and to end dumping in the inhabited area. The bench after hearing both the sides allowed the petition. Hearing adjourned A division bench of Sindh High Court (SHC), comprising on Justice Arif Hussein Khilji and Justice Arshad Noor Khan, on Monday adjourned the hearing over the petition moved by six Taluka Nazims of Sindh till January 27. The Taluka Nazims of different districts including Thatta, Sajawal, Mirpur Sakro, Mirpur Mathelo, Ghakarwari and Shah Bandar have moved a petition and made respondents to DCO Thatta Dr Laik Ahmed, Sindh Local Government and the Local Government Commission. They submitted that the said DCO Thatta has cancelled the tenders which was an illegal attempt. They further stated that DCO misused his powers and violated the rule by interfering. They prayed before the court that the court should abstained him from committing such kind of illegal attempt. Meanwhile, the same bench has adjourned the hearing regarding the petition moved by 1,250 teachers against the non-payment of their salaries till January 27. Hamidullah Jokhio and other teachers filed the petition submitted through Ghulam Nabi Sheikh advocate that they had appointed as teachers in the NCHD while current government had stopped their salaries since their formation. They made respondents to DCO Thatta, District Nazim, EDO Education and Finance and Sindh government.
