LHC questions maintainability of petition


Lahore - The Lahore High Court on Monday questioned maintainability of a writ petition, seeking disqualification of Nawaz Sharif, Shahbaz Sharif, Ch Nisar and Khawaja Saad Rafiq, and asked the petitioner to satisfy the court on its maintainability.
Shahid Orakzi, a freelance journalist, filed the petition and argued that Sharif Brothers and Khawaja Saad were involved in the Supreme Court attack case in 1997, but their nomination papers for the recently held general elections were accepted. Likewise, Ch Nisar had not disclosed his real assets before the Election Commission while his wife and children had foreign nationality. He said all the four PML-N leaders did not meet the criterion laid down under articles 62 and 63 of the Constitution, so they may be disqualified and stopped from holding the National Assembly and provincial assembly seats.
The court observed the writ petition was not maintainable prima facie as the stipulated time to challenge nomination papers had already lapsed. It asked the petitioner to come up on June 11 with arguments on the maintainability of the case.
