LHC appoints court assistants

LAHORE Starting proceedings regarding holding of dual offices by President Asif Ali Zardari, a Full Bench of the Lahore High Court Thursday appointed senior advocates Abdul Hafeez Pirzada, Abid Hassan Minto, and SM Zafar as amicus curiae (friends of the court) to provide assistance in reaching a decision on the issue. The Bench headed by Justice Ijaz Ahmad Chaudhry put off till October 21, hearing on the petition earlier moved by Pakistan Jurists Forum through advocate AK Dogar. Last day, despite notice of the court, no-one appeared to represent the Law department to address the preliminary questions. However, the court noted while proceeding with the matter that previously decision came on the point of two offices of the president but hardly they were carried out. On that Mr Dogar said the matter in hand had gone beyond the question of Presidents two offices, to the area where the court had to determine whether Zardari could continue or not as President of the country. He argued that now the issue whether or not Asif Zardari was competent to hold the Constitutional office of the president which was also an apolitical office, when he was already holding a political office as Co-Chairperson of the PPP. The court has to see whether a person who is already holding a political office is competent to hold a constitutional apolitical office which requires the holder to be impartial, non-partisan and neutral to watch the national interest. On that the Bench, comprising of Justice Iftikhar Husssain Chaudhry, Justice Umar Ata Bandial, Justice Iqbal Hameedur Rahman and Justice Ejazul Ahsan called for the assistance of the said senior jurists and put off hearing till October 21 next. In the original petition the petitioner has raised the issue of holding two offices by the President simultaneously. It contends the constitution does not allow holding of two offices so the respondent may be directed to quit the party office.
