PCB serves ICC with legal notice

LAHORE - The Pakistan Cricket Board has taken the 2011 World Cup hosting rights fight to the court of law feeling that the International Cricket Council decision as discriminatory. Addressing a press conference here Saturday along with PCB legal advisor Tafazzal Rizvi, PCB Chairman Ijaz Butt said that it has served legal notice to the ICC on moving its World Cup matches over security fears. The PCB Chairman said that the security issue was on the agenda and the shifting of the World Cup was not mentioned in the agenda list. "As we know the security matters were to be discussed in the ICC meeting but they scrapped Pakistan of the hosting rights," he said. Pakistan was co-host of the World Cup with India, Sri Lank and Bangladesh. But the last month ICC meeting left the PCB and Pakistan fans fuming. "The PCB believes that the manner in which the decision was taken, with no security assessment of Pakistan or any other host country and without the issue being on the agenda of the meeting, it was legally flawed," PCB chairman Ijaz Butt said Saturday. "As for now I cannot go into details. There are several legal issues involved and we would wait and see the legal consequences of the move. "We feel its discriminatory decision of the ICC for excluding Pakistan of the 2011 World Cup as hosts. We were to give them the security plan and it was their team to assess the security and every other thing. But what it did was not on the agenda. "We have informed the ICC of the military uprising in Bangladesh, Tamil Tigers attacks in Sri Lanka and the situation in India, which has also led to the Australia's tennis team's refusal to play Davis Cup their," said Mr Butt. He further added that there are certain things he cannot mention because the issue in now in the court of law. "We have asked the court that the issue is urgent so that it should be taken up immediately. It should be considered on priority basis," informed Rizvi. He said that the terms of reference are there to serve the notice and "We have done accordingly. My Butt said that the ICC has no right to snatch Pakistan of the World Cup matches hosting keeping in view the situation in the entire region. The notice has been served through Mr. Mark Gay of DLA Piper, London to the ICC. "The PCB believes that the manner in which the decision was taken was legally flawed and the decision to revoke its host status on security grounds while not reviewing that of the other co-hosts of the 2011 tournament was unfair and discriminatory," PCB Chairman, Ijaz Butt, said: "We are most concerned about the manner in which the ICC took this decision. There was no notice prior to the meeting that a decision of this nature would be taken. There was no proper security assessment of Pakistan nor of the other Co-Hosts of the 2011 Tournament. We believe that more could and should have been done to review the actual situation to deal with the matter on a non-discriminatory basis," he added. "The matter has been submitted to the President of the ICC's Dispute Resolution Committee. He can either refer the matter to the Dispute Resolution Committee which is made up of ICC Officials or to independent arbitration before the Court of Arbitration for Sport. The PCB prefer impartial arbitration, in the interest of justice, equity and fair play," he said. "The PCB will push for this matter to be expedited so the PCB's status can be restored as soon as possible," he said.
