LAHORE - The Lahore High Court Chief Justice Umar Ata Bandial gave last opportunity to the counsel of Pakistan Tehreek-i-Insaaf Chief Imran Khan to appear and submit reply, on an application filed by Speaker National Assembly Sardar Ayaz Sadiq here on Monday.
The Chief Justice Umar Ata Bandial expressed displeasure over the non-appearance of the counsel of Imran Khan, advocate Ahmad Awais on last hearing. Chief Justice warned the counsel of fine if he failed again to attend the next proceedings on March 3.
Imran Khan, PTI Chairman, approached the ECP for inspection of the polling record after he lost election from NA-122 against Sadiq. The commission had passed the impugned order on his appeal.
However, Ayaz Sadiq filed a suit in Lahore High Court and challenged the order of the commission. The petitioner said that the scope of duties given in the election laws for Returning Officers could not be extended by a court of law.
He said the RO had no jurisdiction to hold inspection of the record after the holding of the election.
The petitioner stated that the RO did not have any election record presently because the record had already been forwarded to the ECP as required by the law. He said the RO completed his job and did not enjoy the jurisdiction to conduct the proceedings assigned to him by the order of the ECP. Ayaz Sadiq pleaded to the court to set aside the impugned order given by the Election Commission.
