LAHORE - The Lahore High Court Chief Justice hearing a suo moto case about registration of fake cases against husband and in-laws of a love married girl Monday released the arrested persons on bail and ordered medical examination of girls husband and others besides directing police to safeguard their lives. Chief Justice Khawaja Muhammad Sharif also directed the SP (Operations) Rawalpindi Yasin Farooq to ensure the protection and production of the girl, Kulsoom Baloch, before the court on 28th. Earlier on Monday, police produced Fazal Abbas, husband of Kulsoom, and his brother in-law Shafiq Dogar in the court. They told the court that Sub Inspector Malik Bashir of police station Airport Rawalpindi and Sub Inspector Muhammad Sharif of police station Badana, Jhang, brutally tortured them. Police officers present there informed the court that SI Sharif had been arrested in a case registered against him. It was further informed that SI Malik Bashir, who was also present in the court, took Shazia, sister of Fazal Abbas, into custody. The CJ directed the SP Operations Rawalpindi to record the statement of Shafiq Dogar outside the courtroom and get a case registered against the said SI under Section 365 PPC. The SP was also directed to recover Shazia and produce her in the court on 28th, the next date of hearing. At this stage the CJ reminded the SP that no harm should be done to life and liberty of Kulsoom during her travel from Karachi to Lahore while appearing before the court. It was also brought to courts notice that after the arrest of Shafiq Dogar, the complainant party trespassed into his house and took away all the articles. His wife, Riffat Bibi, moved an application and a case was registered against two accused Allah Dad, Nasir Baloch and 18 unknown accused persons. At this the CJ directed Amjad Jalal, SHO police station City Sargodha, to arrest all the accused persons and also get recovered the house hold articles from them and inform about the progress on next date of hearing. Mirza Arif Advocate submitted that Kulsoom Bibi got her statement recorded under Section 164 CrPC wherein she exonerated all the accused persons of the case. However, Hina Jillani said that Kulsoom was presently in Karachi and due to threats to her life she was unable to appear before the court. She said if security was provided to her she could be produced. The CJ asked the SP to ensure girls presence on May 28. A lady, Abida Hussain, also turned up to the court and claimed to be Fazals first wife. She sought divorce from him but the chief justice asked her to approach competent court. The CJ also released Nasreen Akhter, mother of Fazal Abbas, on bail with direction to produce her on May 28. The police had discharged Shafiq Dogar while Amjad Hussain was also granted bail by the CJ. The remaining accused in the FIR could approach court for their bails, the CJ observed. Mehmood-ur-Rehman, real brother of Kulsoom Bibi, had lodged a case on April 25 against Fazal Abbas and his other family members. Later on April 28 one Malik Nasir got his statement recorded under Section 161 CrPC and named Muhammad Shafiq, Amjad Hussain, Riffat, Amjad Bashir, Ansar and Ashraf as accused in the said case but they have not been arrested so far as indicated in the report submitted by the SHO Airport Rawalpindi. The chief justice had taken suo moto notice of the said matter reported in a newspaper and aired by news channels stating that police had registered fake cases against Fazal Abbas and others at the behest of a PML-N MPA from Jhang, also cousin of Kulsoom Bibi. The love married couple, Kulsoom and Fazal, had to take shelter in Karachi to save their lives.
