Personal appearance of PPP co-chairman sought

LAHORE - A civil miscellaneous (CM) application has been moved in the Lahore High Court seeking personal appearance of Asif Ali Zardari as PPP co-chairman before a full bench hearing couple of petitions against his dual offices as president of Pakistan and co-chairman PPP at the same time. This application has been filed by chief of Awami Peoples Party Engineer Ghulam Jilani into his main petition, challenging holding of dual offices by President Zadari already, pending before a full bench of the Lahore High Court for hearing on March 29. In his application the petitioner has taken a plea that constitution of Pakistan allows exemption from personal appearance in the court of law only to the president of Pakistan and not to the co-chairman of PPP. The petitioner submitted since Zardari is holding office of the party co-chairman he should appear before the LHC bench hearing petitions against his double offices. As a president of Pakistan, he is being represented/defended by the attorney general of Pakistan in the cases. The petitioner prayed Zardari was not being defended in the court in the capacity of partys co-chairman and implored that court should direct him to come before the court to explain as to why he is holding a constitutional office of the party co-chairmanship besides office of president of Pakistan. On March 29 the full bench comprising Justice Ijaz Ahmad Chaudhry, Justice Ch Iftikhar Hussain, Justice Umar Ata Bandial, Justice Iqbal Hameed-ur-Rehman and Justice Ijaz-ul-Ahsan will start proceedings on the application along with two other main petitions. Other petitions had been filed by AK Dogar of the Pakistan Lawyers Forum and another lawyer Asif Mehmood against dual offices of Asif Ali Zardari. On the last date of hearing the full bench had adjourned hearing for March 29 due to the absence of attorney general and the court had shown resentment on his absence. The three petitioners have argued through their petitions that act of President Zardari of holding the office of co-chairman PPP was in clear violation of article 41 (1) of the constitution. The petitioners requested that President Zardari should be directed to surrender the office of co-chairperson of PPP.
