Tragedy: LHC also orders SHO to book LDA officials

LAHORE Justice Qasim Khan of the Lahore High Court on Tuesday ordered the SHO Johar Town to register case against four officials of Lahore Development Authority including its chief planner, Johar Town and others for the death of four workers at the plaza which was pulled down when score of labourers were on the upper floors. The court passed this order on an application filed by Mian Shahid Mehmood, the owner of the plaza, through his counsel Aftab Ahmad Bajwa. It may be mentioned here that the District & Sessions Judge Mujahid Mustaqeem had earlier ordered the police authorities to register a case against the LDA officials, SHO Johar Town, DSP concerned and 10 other police officials for the death of four labourers at the LDA plaza. The petitioner said the LDA officials demolished his plaza, 14-A/C-1, in Johar Town, that was constructed as per rules of the authority and after making due payment. The petitioner through the counsel submitted before the court that on September 22 at 1 pm, LDA officials including Director Building Akram Chuadhary, Director EME Abdul Razzaq, Deputy Director Town Planning Azhar Ali and Assistant Director Town Planning Afraz Akhtar along with police officials came to demolish the building terming the same illegally constructed. The counsel argued that the son of the petitioner at that, showed the documents and the stay of order passed by court to the official. He contended that when they showed documents, the LDA officials went away saying they would act in accordance with the law. However, at 8pm the same day, they LDA officials came again to demolish the building. On this, his client requested them to give him time to take out goods and other material lying inside the building but the officials refused to give them time and threatened if they do not leave the building, they will be buried inside. He said that family members under threat immediately left the building. However, LDA staff had to call off demolishing as driver of the crane said the machine had gone out of order. The counsel said that next day (September 23) about 8p.m. said officials along with policemen and 30 labourers and heavy machinery came at the spot and started demolishing the lower portion of the building without taking proper care. This resulted into collapse of the building and death of four laborers and injuries to others. The petitioner counsel further argued that he lodged an application with the concerned police station but no action was taken on it. After hearing the counsel, the court passed directions to the SHO for registration of a case against aforesaid persons. The counsel said the petitioner has also nominated SHO Johar Town in the petition but the same official will not register case against himself. On this, the judge directed Naib Court (court staffer) to go along with the counsel at Johar Town Police Station and make sure the implementation of the court orders.
