Spies’ counsel challenges SC authority in Fata

ISLAMABAD - Hearing a case against the detention of missing prisoners in internment centres, the Supreme Court has urged the federal and provincial governments to extend the superior court’s jurisdiction to the Federally Administered Tribal Areas (Fata).A three member bench, headed by Chief Justice Iftikhar Muhammad Chaudhry, is hearing an application of late Rohifa for recovery of her sons, who were abducted by spy agencies after their release from the Adiala Jail in 2010.“We will decide in this case that the Supreme Court’s jurisdiction should be extended to Fata, as it is the will of the people that the Supreme Court and high court must have jurisdiction in tribal areas,” the chief justice said in his remarks.The chief justice asked the counsel for spy agencies, Raja Irshad, that everything should be done in accordance with law as proceedings against the persons without evidence would create frustration in the country. However, the counsel for spy agencies challenged the court’s jurisdiction in Fata.Justice Jawwad S Khawaja observed it was a matter of concern that people were being abducted from settled areas and later on, shifted them in tribal areas, wherein the question of apex court’s jurisdiction was raising.During the hearing, Tariq Asad, the counsel for applicant, said 11 missing prisoners were abducted from the Adiala Jail by intelligence agencies in 2010 as they were in illegal confinement for last two years. He said that four prisoners had already died in the confinement as remaining persons could also be died in internment centre.The counsel said if the court did not proceed in this matter then independence of judiciary might face threat.Later, the hearing of the case was adjourned till today (Thursday).
