IHC moved for dismissal of FIR against Lal Masjid cleric

ISLAMABAD - Petition has been filed on Thursday in Islamabad High Court (IHC) for the dismissal of FIR registered at Aabpara Police Station and stopping the trial in lower court against Khateeb Lal Masjid Maulana Abdul Aziz for instigating the students and people against the state. Counsel for the petitioner, Muhammad Wajeehullah Khan, filed the petition, which was accepted and will be heard by Justice Mohammad Anwar Kasi on Friday. The petitioner has pleaded that policemen on routine patrolling found a CD from outside the Lal Masjid. The CD was having instigating material. Aabpara police registered case under MPO 16 and under the section 6 and 7 of anti-terrorism act. Police on October 2007 submitted the Challan in the court. Without having the prior permission of area magistrate in such cases police couldnt register the case. The police on behest of the high ups registered the case and included the sections of anti-terrorism act. On April 8,2009 the judge of anti-terrorism court ordered to remove the said sections from the FIR and forwarded the case to relevant court, petitioner has pleaded. Moreover, the petitioner has pleaded that no material was recovered from the custody of Maulana Abdul Aziz and the FIR logged was in deviation of law. The court has been requested to quash the FIR and issue order in regard to end the proceeding in the court of Judicial Magistrate Islamabad Kashif Qayum. It would be relevant to mentioned here that IHC earlier has quashed FIR registered at Aabpara Police Station against Maulana Abdul Aziz in a case of pamphlet distribution to instigate student and public and has ordered to end the trial in lower court.
