ISLAMABAD - The Supreme Court on Tuesday issued a notice to Attorney General for Pakistan regarding non-acceptance of the Judicial Commissions recommendations by Parliamentary Committee (PC) with respect to four honourable judges of Lahore High Court. Advocates Munir Hussain Bhatti and Kamran Murtaza under Article 184(3) of the Constitution have filed the constitutional petition on behalf of the judges whose names were not accepted by the PC. The LHC?CJ recommended a number of names of the additional judges of the LHC. The Judicial Commission scrutinised those names in detail and, thereafter, recommended extension in service of 24 Judges of the said High Court to Parliamentary Committee for another year. The PC, however, accepted the recommendations of Judicial Commission for 20 judges and rejected four judges namely Justice Muhammad Yawar Ali, Justice Syed Mazahir Ali Akbar Naqvi, Justice Mamoon Rashid Sheikh and Justice M Farrakuh Irfan Khan. The petitioners prayed that the Court may be pleased to accept this petition, quash the recommendations of the Parliamentary Committee in respect of the four learned judges of the Lahore High Court and direct the respondent to implement the recommendations of Judicial Commission and issue a notification in consonance there with. The Court may be pleased to suspend the recommendations of the Parliamentary Committee and restrain the respondent from issuing any notification in pursuance of the recommendations made by the Parliamentary Committee or interfering with performance of the function of aforementioned judges.
