LAHORE - Lahore High Court Chief Justice Umar Ata Bandial on Friday disqualified another dual-nationality MPA Rana Asif. More than three months ago, the chief justice suspended his membership on a petition moved by Faisal Ilyas advocate.Counsel for the PML-N MPA Jamshaid Rehmatullah, Deputy Attorney General Naveed Inyat Malik and the petitioner’s counsel, Saiful Malook, appeared in the court.The deputy attorney general told the court that the petitioner was not an aggrieved party. He contended that the court could disqualify a person on the application of the Election Commission of Pakistan only. He prayed to the court not to disqualify the PML-N MPA. Rejecting his arguments, the chief justice disposed of the petition, asking the ECP to withdraw the notification regarding the respondent MPA’s assembly membership.Rana Asif was appointed as the Punjab finance minister this year, but resigned in June two days prior to the passage of the provincial budget over the issue of the dual nationality.The petitioner had submitted that Rana Asif possessed an overseas identity card which was granted only to a Pakistani citizen who secured passport of another country as well. He alleged that the respondent MPA was a Canadian national and under Article 63 of the Constitution, a person holding dual nationality could not become a member of any assembly or the Senate.He further contended that Rana Asif was a Muslim, but was elected an MPA in the general elections 2008 against one of the seats reserved for non-Muslims. He said Asif was also a citizen of Canada. For that reason, the portfolio of the provincial finance minister was taken back from him, he pointed out. He added that the Supreme Court had disqualified many parliamentarians on for possessing dual nationality. “He is a Canadian national as well as a Pakistani and, in the light of the decision of the SC, he is ineligible to become an assembly member,” the petitioner added.
