SC nullifies RPPs agreement, orders action against ex-minister

The Supreme Court (SC) Friday declared Rental Power Projects agreement illegal and directed National Accountability Bureau (NAB) to initiate legal proceedings against Raja Pervez Ashraf, former minister for water and power.
SC had reserved judgment on December, 14, 2011 on the petitions of federal minister for housing Makhdoom Syed Faisal Saleh Hayat and PML-N leader Khawaja Asif in rental power agreement case.
The SC resumed the hearing of the case on Friday under the Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry.
The court while pronouncing the decision containing 90 pages nullified all the rental power agreements by the government declaring them illegal and ultra vires of  the constitution.
SC remarked GESCO, PEPCO and Wapda failed to discharge their obligations therefore, all the corrupt elements, government officials, federal ministers and  signatories who were involved in these agreements  and those who approved them no matter they are federal ministers be proceeded against under NAB ordinance.
SC further remarked that there were successful bidders other than GESCO, PEPCO and NEPRA and proceedings at both level,  civil and  commercial  could be initiated against them, therefore, they be proceeded against.
SC ordered NAB to take legal action against those who were involved in rental power projects corruption including former federal minister Raja Pervez Ashraf and former secretary for ministry of water and power Shahid Rafi and a report in this regard be sent to the court after every 15 days.
The court thanked minister for housing Makhdoom Faisal Saleh Hayat and PML-N leader Khawaja Asif for assisting it in the case.
Regarding Makhdoom Faisal Saleh Hayat it was laid down in the paragraph that he discharged his responsibilities under the constitution being elected representative of people.
The court verdict said the elected representatives of the country should play their role for the sake of sovereignty of the country.
It may be recalled Khawaja Asif filed application on October, 21, 2010 for becoming party in the case.
Faisal Saleh Hayat had given statement that massive corruption had taken place in RPPs agreements and requested the court to take notice of it. He alleged 5 billion dollars were extracted from the pockets of the people in these agreements.
