Woman needs no mahram to proceed for Haj, says CII
By IRFAN BUKHARI November 16, 2008 ISLAMABAD -The Council of Islamic Ideology (CII) has recommended that if a wife demands divorce in writing, it should be made binding on husband to divorce her within ninety days of her written request, and if he fails to do so, Nikkah would stand cancelled except if the wife withdraw her demand.
“After this, the husband will have no right to have the same woman as wife. If the husband has given his wife some assets and demands the same, the wife will have to return those assets except for “Mehr and maintenance” or else she will have to make recourse to a court of law for the resolution of the conflict”, recommended the Council.
Reviewing Family Laws, the Council in its meeting held here on Saturday, also proposed formulation of a Talaq Nama, like Nikkah Nama, according to which the registration of divorce in Pakistan could be recorded.
