Judges dismissal, Tikka Iqbal cases can be reviewed, says CJP

ISLAMABAD - Chief Justice Iftikhar Muhammad Chaudhry Thursday observed that cases regarding dismissal of
judges and Tikka Iqbal Case could be reviewed if necessary.
The three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Ch and comprising
Justice Raja Fayyaz Ahmad and Justice Chaudhry Ijaz Ahmad, while hearing the case of Sindh High Courts
judges, Justice Zafar Sherwani and Justice Rashid Kalhore, directed for clubbing the case of three other judges,
Bin Yameen, Pir Ali Shah and Arshad Anwar Khan, with the case in hand.
The Chief Justice further said that a larger bench could also be constituted for hearing the judges case.
Rashid Ahmed Rizvi, counsel of the judges, argued before the court that the November 3, 2007 act of the then
President Pervez Musharraf was unconstitutional and illegal, as per the verdict of a 12-member bench of the
Supreme Court, judges could be removed only under Section 209 of the Constitution, he argued.
Justice Zafar Sherwani and Justice Rashid Kalhore were appointed additional judges of SHC on Sept 15, 2007
for one year but despite made permanent, the government had issued a notification of their retirement after
passage of six months only.
The Attorney General, Sardar Latif Khosa requested for more time for preparation, upon which the SC directed
him to club all appeals regarding dismissal of judges and adjourned the hearing for two weeks.
