Plea for holding by-polls in NA-123

LAHORE - Advocate M Azhar Siddique has moved an appeal before the Supreme Court of Pakistan, requesting to
issue directions for holding by-election for National Assembly seat NA-123, Lahore.
He filed this petition on Saturday at Lahore registry of the Supreme Court. Petitioner challenged the Lahore High
Court order of the division bench requesting the court to direct the election commission of Pakistan to hold
by-elections in the vacant constituencies of the province.
On Nov 25, a division bench of LHC comprising Justice Umar Ata Bandial and Justice Ijaz-ul-Ahsan had dismissed
three appeals against delay in by-elections upholding the decision of a single bench. The single bench on a petition
of Punjab govt had stayed the holding of by-polls in the province on account of deteriorated law and order situation
and a point of “condemned unheard’ raised by the government.
Petitioner said that the provincial government was not competent to approach a court of law to delay the election as
holding of election was exclusive right of the election commission of Pakistan. He said the government took the plea
that the law and order situation was not suitable for conducting election, which was a lame excuse.
He stated that even after death of Benazir Bhutto the elections were held and in recent past elections were
conducted in Gilgit and Baltistane. He requested to issue directions to the election commission to hold the election.
