SC restrains FDE from transferring Dr Shahnaz

ISLAMABAD – The Supreme Court on Thursday declared all the orders transferring Dr Shahnaaz A Riaz, former Director General Federal Directorate of Education (FDE), to the Academy of Education Planning and Management void ab initio.

A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain heard petition of Dr Shahnaaz A Riaz against Secretary Capital Administration Development Division (CADD).
The court restrained the FDE and Secretary CADD to transfer Dr. Shahnaaz to any other department and decide about her posting and transfer strictly in accordance with law within the FDE with all perks and privileges and if there is any outstanding towards her salary and utility bills, those shall also be paid by the FDE within a period of two weeks.
The court after hearing the arguments of Deputy Attorney General Babar Ali converted her petition into appeal and allowed. As a result of that the petitioner stands repatriated to FDE, Islamabad, and all the orders transferring her to the Academy of Education Planning and Management, dated 19.02.2010 are declared to be void ab initio.
The Deputy Attorney General told the court that after the pronouncement of the judgment of the Service Tribunal dated 16.01.2012, no action within a period of two months, stipulated by the Service Tribunal, has been taken because it was informed that in this context a summary was sent to Prime Minister on 22.03.2012, but it has not so far been returned.
The court also noted that as Dr. Shahnaaz has been made to suffer unnecessarily; as a result whereof she was compelled to resort to the litigation, therefore, she is held entitled for special cost of Rs 50,000, which would be paid by the respondents individually and jointly and would be deposited with the Registrar of this Court within 15 days”.
The case was adjourned for two weeks.
