Chief Justice (CJ) Iftikhar Muhammad Chaudhry has remarked no one should remain under any delusion as court is fully cognizant of its powers and knows how to exercise them.
Secretary FATA, Jamal Nasir, Attorney General (AG) Irfan Qadir and counsel for petitioners appeared in the court.
CJ admonished deputy attorney general Ali Zai for coming in the court late remarking “court starts functioning from 9 a.m and you people reach your office at 11 a.m. Punctuality of time norms be followed in future”.
AG told the court applications in respect of 7 persons have been received in connection with their release from the detention centers. However medical check up of all the persons will be carried out first and later their applications will be decided.
CJ observed “ it seems as if you have got no evidence, therefore, you are talking in this fashion.
AG said “you will also have to see if the court is empowered to hear this case in the perspective of FATA”.
CJ remarked “ Don’t tell the court about its powers. We fully know what are our powers. Court knows how to exercise its powers. Do you want innocent are convicted and we remain silent. Injustice will not to be allowed to be done to any one. Missing persons matter is highly sensitive. Court cannot shut its eyes to it. No evidence could become available for putting Adiala jail missing prisoners to trial and matter of their medical check up is being talked of”.
Secretary FATA Jamal Nasir told the court medical check up of all the prisoners has been completed and reports thereof have been sent to governor. Court can summon these reports from the governor.
CJ said upon it “ we know nothing more. You please provide revised reports and all the record to the court.
The court adjourned the hearing of the case till February, 26 and directed Secretary FATA to provide medical facilities to all prisoners.
