Prime Minister Yousuf Raza Gilani’s lawyer in the contempt of court case, Barrister Aitzaz Ahsan said on Friday that Speaker National Assembly Dr Fehmida Mirza made a right decision by not sending the reference against the premier to the Election Commission of Pakistan. Talking to media persons here, the Supreme Court verdict mentioned the ‘possibility’ of ineligibility of the prime minister, while the speaker has decided the question of ‘possibility’. He said only the speaker is authorised to make decision on the question of ineligibility of any member of the National Assembly. Aitzaz said he has worked hard to file an appeal against the prime minister’s conviction, adding that he would be disappointed if the government decided against filing the appeal. He said the appeal contains 146 objections on the court order. He said Barrister Gohar, Kashif, Bilal Khokhar, Fayyaz, Ayesha Malik and others will file the appeal. However, he said, discussions are ongoing in the party that now the PM has gone through the ‘punishment’ and the speaker has also given its verdict, then there is no need to further drag the matter. He said he has never come across the word ‘ridicule’ in the prime minister’s indiction, therefore, the question of PM’s disqualification does not arise. He said the judges repeatedly said during the hearing of the contempt case that the prime minister ridiculed the judiciary during his address in Bahawalpur. He said this is a separate matter which need a separate indiction and then the court could proceed further in this regard. Aitzaz said the speaker in her ruling mentioned that ex-PML-N MNA Javed Hashmi was convicted according to article 63(1)(G) and in PM’s case there was nothing about indiction neither any proof regarding ridicule came to surface. He said the judges even didn’t question the premier about the ‘ridicule’ during the proceedings.
