ISLAMABAD– The Islamabad High Court has given a stay order in the implementation of a Presidential Amnesty to a guard of real estate tycoon Malik Riaz and issued notices to Federal Secretary Interior, Secretary Aiwan-e-Sadr, Punjab Home Department and guard Basharat.
During hearing of the case by a two-member bench of the IHC comprising Justice Riaz Ahmad Khan and Justice Azeem Khan Afridi, Advocate Chaudhry Mohammad Ashraf Gujjar said that guard of Malik Riaz opened indiscriminate firing in front of court of Sessions Judge Islamabad on 9th January, 2010 in which one person was killed. The firing also created scare among the people present there.
The Advocate said the Anti-Terrorism Court awarded life imprisonment to guard Basharat. However recently Punjab Home Department received a letter from the Interior Ministry that he has been granted amnesty by the President. He contended that the President has no power to grant amnesty to a convict involved in terrorism.
He pleaded the court to declare the letter of Interior Ministry illegal. After hearing the arguments of the lawyer the court adjourned the hearing till 28th June.
