SC orders action against G-B top cop

ISLAMABAD - Chief Justice Iftikhar Muhammad Chaudhry on Wednesday ordered for submitting the suspension notification and the steps taken against Gilgit-Baltistan (G-B) Inspector General of Police (IGP) Hussain Asghar for not reporting back to the FIA Headquarters. Hussain Asghar, who had been investigating the Haj corruption case as a FIA director FIA with the entire satisfaction of court and collected important evidences against the accused, was appointed Gilgit-Baltistan Police chief after ex-DG FIA Malik Iqbal wrote a letter to Interior Ministry. A three-member bench - headed by Chief Justice Iftikhar Muhammad Chaudhry and also comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain - was hearing a suo moto case of corruption during the performance of Haj in 2010. During the last hearing, Attorney General Irfan Qadir had informed the court that the federal government had issued notification regarding cancellation of Hussain Asghar’s transfer order as Gilgit-Baltistan IGP and was directed to report back to the FIA Headquarters immediately.But on Wednesday, Deputy Attorney Dil Muhammad Alizai, instead of the attorney general, appeared before the court and said Hussain Asghar had not come back. In his observation, the chief justice said, “Suspend him (Hussain Asghar) forthwith”, adding that he should be no more be Gilgit-Baltistan Police chief, as the establishment Secretary had given commitment in writing to the court. Justice Khawaja stated that according to the civil services rules, the government servants were bound to follow the government orders, and they had to work in a place where they were posted. The chief justice said Hussain Asghar should be suspended under Section 5 of Efficiency and Disciplinary Rules. He questioned why the government had not proceeded against him, to which the deputy attorney general replied that on June 19, the relevant authority had written a letter to Hussain Asghar and now they were proceeding against him in accordance with law.The chief justice directed him to submit the notification and steps taken against Hussain Asghar for not complying with the orders and adjourned the case till June 28.
