Advocate Rahim had filed the petition in the IHC in Sept 2012 against the extension in the service of the army chief, but Chief Justice Iqbal Hameedur Rehman had dismissed it on Sept 24, citing Section 3 of Article 199 of the Constitution, which says that the high courts could not hear cases pertaining to the service of armed forces personnel.
Then he had filed an intra-court appeal against the said order.
In the appeal, Inamur Rahim had contended that General Kayani was not subject to the Army Act, 1952, as he had attained 60 years of age on April 20, 2012, after which no one could serve in the army.
