February 07, 2013

LAHORE – The Supreme Court on Wednesday directed FIA Director of Punjab to determine legitimacy of an air-ticket allegedly purchased by Nadir Feroze Khan, managing director of Efroze Chemical and an accused in PIC spurious medicine scam.
A full bench of apex court at Lahore registry resumed hearing the appeal filed by wife of Nadir Feroze Khan against arrest of her husband by police.
Model Town Superintendent of Police Ijaz Shafi Dogar presented an international air-ticket to the court and said that it was an E-ticket purchased through a credit card on Jan 28, last. He alleged that the accused was trying to escape abroad; however, police had arrested him from Lahore airport.
On the other hand, counsel of the accused rejected the allegation and showed a domestic air-ticket saying he (Feroze Khan) was going to Karachi to hold a company meeting.
The bench summoned FIA Punjab Director Waqar Haider on short notice and directed him to investigate the matter and find out the real purchaser of the foreign air-ticket.
The bench adjourned further hearing till Feb 13.
The appellant said her husband had got pre arrest bail from sessions court but police arrested him.
The court had ordered the release of the accused and directed him to record his statement before the sessions judge, Lahore.
A government’s inquiry had held the Karachi based pharmaceutical company guilty of providing spurious medicine (Isotab) to Punjab Institute of Cardiology (PIC). Hundreds of cardiac patients across the province had lost their lives after using the medicine.
Pre-arrest bail extended: District and Sessions Judge Nazir Ahmed Ganjana extended pre-arrest bails of Deputy Managing Director Nadir Feroze and General Manager Shakeel Nagra of Eferoze Chemical Industry for February 9.
The judge gave last opportunity to the counsel for accused persons to complete arguments on bail petitions after counsel for the accused sought more time on plea to go through the case as well as the report of Judicial Tribunal. However the court handed him over the report of Judicial Tribunal of the Lahore High Court. The counsel for the accused contended that this matter was being heard in Supreme Court while a petition was pending in District & Sessions Court seeking registration of case against those police officials who arrested the aforesaid accused despite they were on bails.
He implored the court that we should wait the court verdicts that will help to conclude this case.
On the other hand prosecution contended the court that the case was being delayed for nothing. It further added that the counsel of the accused should argue on bails rather than lingering on the matter.
