RE - Chief Justice Lahore High Court (LHC) Khawaja Muhammad Sharif on Tuesday summoned DSP organised crime CIA Cantt for misleading the court during hearing of a suo moto notice against murder of Muhammad Nasir Advocate in Lidhar Pind, a village in proximity of Lahore.
The complainant party was not present in the court when the DSP appearing in the court stated that accused had not been arrested yet, however, complainant party had made some compromise with the accused party. He stated the complainant party specially told him that police should not arrest one of the accused namely Shaukat Ali, Sub Inspector (SI), because he was helping complainant party in arrest of main accused having major role in the murder case.
The CJ was about to disposed of the suo moto notice on the statement of the DSP but before the CJ could dictate his order Abdul Hameed, deceaseds brother and complainant of the murder case, reached in the court along with his relatives. Later, when the complainant came to know about the DSPs statement he appeared before the chief justice to narrate facts. He said he never stated before the DSP or any other police official that they had done some compromise with the accused and never said that SI Shaukat Ali should not be arrested.
The CJ heard version of complainant Hameed and told him that suo moto will not be disposed of until the accused are arrested. It was a tripe murder case in which Muhammad Nasir Advocate, his brother and a cousin were also gunned down due to an old enmity. The CJ had taken suo moto notice of the case on March 3, 2010 when the incident created a law and order situation in the City as residents of the village of the deceased lawyer blocked the roads in protest against the cold-blooded murders. The CJ directed Hanif Khatana, additional advocate general Punjab to summon DSP Athar Farooq in the court on August 20. The CJ will resume further proceedings on the same day.
