ISLAMABAD - The National Accountability Bureau on Thursday informed the Supreme Court that it has suspended three officials for misusing the apex court's name to remove two of its investigation officers, who were probing corruption in Rental Power Projects.
Deputy Prosecutor General NAB Fozi Kazim presented a report about the suspension of NAB officers. The Chief Justice said: "We didn't ask you for it." He inquired from the DPG that why they have written that the officials were suspended on the direction of the apex court. The chief justice asked him to take action against the officials on their own but don't write SC has directed the NAB.
Fozi Zafar after the break informed the bench those three officials, including Principal Secretary to Chairman Farooq Nasir Awan, Director General NAB Rawalpindi Subha Sadiq and Investigation Officer in RPPs Shehzad Bhatti.
He prayed; "Please pardoned them as next time they will be careful in future," adding "If you will pardon them then we will withdraw the letter." The chief justice asked the DPG; "You withdraw the letter and we will direct for the registration of case against the officials."
The court observed there is no fault of Shehzad Bhatti as the chairman had given him directions and questioned why the action has not been taken against the chairman? The chief justice said that they could also summon the chairman.
Brigadier (retd) Farooq Nasir in the removal letter has written; "IOs (Shehzad Bhatti) concerned be removed since the Supreme Court doesn't seems to be happy with their performance." He appearing before the bench informed that DG NAB has drafted the letter and he only signed on it. He said that Shehzad Bhatti had told the DG that he should be removed.
The court has inquired from the NAB to tell how many challans have been and the persons involved in the corruption of Rental Power Projects arrested. He said it shows there is no fairness. The Court observed that though the NAB chairman says that daily there is billions of corruption besides that not arresting those persons who are involved in huge corruption of RPP.
The court noted that Asghar Khan was removed because he included incumbent Prime Minister's name in the reference. Instead of arresting low officers take the action against the influential, the CJP said.
The Supreme Court in the two separate judgments has directed the NAB to take action against the responsible persons including Prime Minister Raja Pervaiz Ashraf as he is among the five responsible persons who recommended for the illegal appointment of Tauqir Sadiq as Ogra chairman. Raja Pervaiz Ashraf is also one of the main accused in the misappropriation of Rental Power Projects (RPPs).
Earlier, appearing before the bench Farooq said that he would resign. The chief justice asked him to resign and set the example for others. "We have always said follow the lawful orders."
