‘PM not a monarch’

ISLAMABAD  - Justice Jawwad S Khawaja has remarked the prime minister is not a monarch and is not at liberty to do whatever he wills.
He passed these remarks during the course of hearing of the OSD officers’ case in the Supreme Court Monday. The other member of the bench was Justice Khilji Arif Hussain.
The reply of former establishment secretary Ghias-ud-Din Ahmad was produced in the court. The reply said Hassan Waseem Afzal was performing his duty as principal secretary to the then Punjab governor Salman Taseer when he was made an officer on special duty (OSD) and sent to the Establishment Division on the verbal orders of former PM Yousuf Raza Gilani.  Justice Jawwad S Khawaja remarked, “We have to see what the legal position of verbal orders of PM is.”
 Monarchy has been abolished since long. A PM is not a monarch who can do whatever he wills. Arbitrary decisions cannot work now. This cannot happen now that one is appointed here and another at Kot Safdar.” 
Hassan Wasim Afzal told the court that he was working as the principal officer with Salman Taseer when Asif Ali Zardari who was not the president of Pakistan at that time came to the governor’s house and asked him to leave the governor’s house.  Justice Jawwad S Khawaja remarked salaries were not paid to public servants by any king or prince.  The hearing of the case was adjourned for an indefinite time.
