ISLAMABAD (Online) - Chief Justice of Pakistan Iftikhar Chaudhry has rejected the reference sent by President Zardari against the PCO judges saying the latter should be informed that the PCO judges have never been judges and the reference has no legal standing. As per documents available with a private TV channel, Supreme Court Registrar Faqir Hussain sent a letter to Law Secretary Masood Chishti on June 28 that he should inform the president that the CJP had refused to accept the presidential reference sent by him against the PCO judges. With reference to the CJP, it was written in the letter that it seemed the president had not been apprised of the facts, therefore, he filed the reference against the PCO judges in the Supreme Judicial Council instead of sending them to home. The SC had given the decision that the PCO judges were never judges and the reference in this connection had no legal standing. The SC had dismissed the petitions of these judges last month and issued orders for removing them forthwith. Two among the seven judges stand retired while five of them are still working. The president had sent the reference to the SJC against these judges whereby it was stated that the government had no authority to remove these judges under the constitution and only the SJC could remove any judge after conducting due proceedings. It was said in the reference that the president wanted the SJC to inform him after initiation of proceedings against the judges whether or not they were accused of misconduct by taking oath under the PCO and that they had no right to stay as judges. It was also said in the reference that the president would take decision for removal of these judges after seeking opinion of the SJC.
