Judicial activism becomes a compulsion, says Justice Javed

ISLAMABAD -Acting Chief Justice of Pakistan, Justice Javed Iqbal Thursday said that the Supreme Court would soon take up the case of missing persons. The majority of missing persons have been recovered on the courts orders and the media should highlight such recoveries, he said while talking to media after taking oath of Acting CJP. He said that the exact number of missing person could not be identified while 101 missing persons had been traced so far. He further said that the case of missing persons couldnt be solved without collaboration of the government and the spy agencies. He assured the media persons that the remaining missing individuals would soon be found out. Responding to a question, Acting CJP said that Supreme Judicial Council was gathering information about alleged link between Chief Justice, Islamabad High Court, Justice Muhammad Bilal and a notorious criminal and he would be able to speak anything in this respect after complete inquiry. The elimination of corruption is the responsibility of judiciary and nation and the judges should be appointed on merit, he observed. He said that some elements in the Supreme Court were involved in corruption and action should be taken against them. Justice Javed Iqbal noted that Chief Justice Iftikhar Muhammad Chaudhary was striving to resolve problems confronting the nation. Acting CJP said that the Parliament had its own business defined and the judiciary was not a law-making institute. He said that the Supreme Court would continue to work within its constitutional limitation and its every step would be for countrys integrity. Parliament is supreme as it is the only constitutional body that can do legislation while Supreme Court is bound to follow the laws, he said. He said that the judiciary did not want clash among institutions, as it would be harmful for countrys integrity. The Supreme Court faces several challenges out of which corruption is the biggest and steps are being taken to cope this menace. We are supporting the strategy adopted by Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhary for elimination of corruption from judiciary, he observed. He said quick disposal of pending cases in the apex court would be given priority. Acting CJP urged the media to avoid spreading such news stories, which could cause despondency among the nation. It is our priority to dispose off pending cases in the Supreme Court, he said, Justice Javed Iqbal refused to comment on PCO Judges. He said that the apex court would try its level best to come out to the expectation of masses. To another question, he expressed satisfaction over countrys current situation saying it was improving day by day 'however we would have to give priority to national interest rather then personal interest. To a question, he said heading the press council was not a government job and if he had been interested in government job he would have taken the oath as PCO judge and become Chief Justice. Earlier, Justice Javed Iqbal took the oath of acting Chief Justice of Supreme Court. Justice Sardar Mohammad Raza administered the oath to him. The ceremony was held in the Supreme Court building. Chief Justice Iftikhar Chaudhry is in Saudi Arabia to perform Umrah. Judges of the Supreme Court, attorney General, Federal Law Secretary, Secretary Election Commission of Pakistan, Officers of the Law & Justice Commission of Pakistan, Lawyers and Law Officers of the court attended the ceremony.
