LAHORE The PML-N on Monday called for the trial of former president General (r) president Pervez Musharraf under Article-6 of the Constitution for imposing martial law twice, subverting the Constitution and violating the oath taken by him as the Chief of the Army Staff. In a charge sheet issued on the eve of the 11th anniversary of the overthrow of the PML-N government, the party urged the government to bring Musharraf back to Pakistan through Interpol for a trial. It also demanded the formation of a commission to probe the Kargil misadventure. Although the PML-N has been criticising Musharraf on various counts in the past as well, it is for the first time in 11 years that it came up with a comprehensive charge sheet and a set of demands against the man who has been living in self-exile for the past two years. The party called for penalising Musharraf for the human rights violations in lieu of NRO, abductions, massacre, disappeared people and putting curbs on the media. The party wants transformation of his resignation into dismissal and revoke his entire fringe benefits, facilitations and immunities which he is currently enjoying as a retired government official (army chief). It demanded an independent commission to inquire into the matter, which he admitted in his book 'In the Line of Fire with a special reference to his revelations that he had been receiving a handful amount mounting to billions of US dollars for the war against terror and handing over the people to the United States which are commonly described as missing persons. The charge sheet said Musharraf kept the elected prime minister (Muhammad Nawaz Sharif) behind bars in the Attock Fort, (illegally) detained judges of the superior courts (Supreme Court and High Courts) with their family members and imposed (military) dictatorship at gunpoint. This way, he acted against the Constitution of Pakistan in 1999, overthrew an elected government and dissolved assemblies thus being liable to be tried for high treason under Article-6 of the Constitution, the document reads, an offence punishable with capital punishment. The charge sheet said, Musharraf violated the Constitution again on 3rd November, 2007, when he imposed emergency, which has been termed as mini-Martial Law and destroyed judiciary in the country. He is on record to have said that he acted extra-constitutionally. After illegally taking over power, it said, Musharraf committed serious crimes against the Constitution, the state and the people of Pakistan. His rule brought innumerable miseries to the people of Pakistan. He has been the most corrupted, callous, immoral and ruthless ruler of the country and people were subservient to his whims and wishes. It is high time, he is tried otherwise Pakistan would never be able to get rid of imprudent, self-righteous Napoleonic idiocy of military regimes. The charge sheet further said Musharraf planned and undertook the Kargil misadventure, concealing it from the elected government, sacrificing some 800 Pak Army personnel. Also, it said, he used Army as his personal force, tried to corrupt it and gave promotion to his blue-eyed officers. He used the Army for different unconstitutional and illegal actions meant to prolong his rule, badly affecting the credibility of the national institution. It also accused Musharraf of pushed the Army into an undeclared war against its own people without seeking approval from the Prime Minister, Cabinet and Parliament, which has so far resulted in the killing of many Army men and thousands of civilians. According to the charge sheet, Musharraf blackmailed and subjected different people to torture and abuse, using the National Accountability Bureau (NAB) to form PML-Q. The murder of Nawaz Akbar Bugti is also mentioned as a crime committed by the former military dictator, saying he had congratulated the people involved in the killing. Also, thousands of Baloch political workers were made victims of enforced disappearance, with their family members still unaware of their whereabouts. The PML-N also charged him of the Lal-Masjid incident under the pressure of the 'Israeli-Zionist Bush-Cheney Junta of War Criminals. It also claimed that over 650 Pakistanis and Afghans were illegally picked up from different parts of the country and later handed over to the United States in return for dollars. Another charge levelled is the cronyism, nepotism, corruption and favouritism, saying Musharraf accumulated assets worth billions of rupees through close associates by massive contracts from NHA, OGDC and PIA, besides earning billions of rupees in defence deals. The documents also mentioned dismissal of Chief Justice Iftikhar Muhammad Chaudhry on March 9, 2007 and the other related developments. It says Musharraf played inevitable part in the ruthless killings of 48 people on May 12, 2007, when the deposed Chief Justice Iftikhar Muhammad Chaudhry was supposed to address the lawyers in the metropolis. Similarly, more than 150 lives were lost on the day (October 18, 2007) when the PPP leader Benazir Bhutto returned in the country after her exile of nine years, which necessitates an inquiry to unearth the truth. It also cited promulgation of NRO as the worst ever law in the history of civilised world. The PML-N says Musharraf took over power illegally and then and perpetuated his rule through an unconstitutional referendum and a so-called vote of confidence from the Electoral College. Later, he being an army chief contested the presidential election in 2007, which was again violation of the Constitution as well as his oath an army chief. All his acts as well as his election to presidency in 2007 were in clear violation of the Constitution. This again made him an offender under the articles 6 and 43 of the Constitution.
