Adherence to law should not be one-sided: Babar

ISLAMABAD Federal Law Minister Babar Awan has rejected the rumours of clash between the executive and the judiciary, and termed the news of revocation of the executive order regarding judges reinstatement as baseless. Holding a joint press conference with Federal Information Minister Qamar Zaman Kaira at the Press Information Department here on Friday, Dr Babar said, Adherence to the Constitution and law should not be one-sided but across the board. He said no constitutional institution should feel any threat in the presence of an elected Parliament and a democratic set-up. The Prime Minister would address the nation on Sunday, he said. He rebuffed those who were using government resources for doing politics. He said that those institutions should remain silent, which were not allowed to do politics. The Minister said that the incumbent democratic government would not do anything unconstitutional and illegal. He said the PPP-led government was well aware of its constitutional and legal obligations and would function for the strengthening of the institutions. Dr Babar said a judicial stay was already in place in Sindh High Court Bar Associations case and the second was issued on Friday. He questioned, Do judicial orders ever require executive orders? It was a wrong perception that Pakistan Peoples Party was not aware of the efficacy of Article 6 of the Constitution, pertaining to trial of a person under treason, he said and added that they were aware of the effectiveness of Article 6 when a dictator violated and abrogated the Constitution for nine years and was not tried. We are victims of ultra and unconstitutional steps. No one should expect that we will bring further ECOs and PCOs etc, he added. Dr Babar said those institutions which were not allowed constitutionally to indulge in politics, should avoid it. If anyone feels that he is popular among masses, he should quit the perks and privileges, he added. The person who abrogated the Constitution was given extension to rule the country, he added. To a question, the Minister said defamation laws in Pakistan were ineffective and required amendments under the contemporary laws and requirements. He said the Accountability Courts were functional and if anybody had complaints against them, they should approach these. Those elements which had been crying for accountability for the last nine years are now residing outside the country, he added.
