'Institutions must work within limits

ISLAMABAD -Besides approving Ramazan package and other important decisions of ECC, Federal Cabinet on Wednesday expressed resolve to uphold the dignity of all institutions of the State and to protect the rule of law and authority of the Federation. In the Cabinet meeting chaired by Prime Minister Syed Yousuf Raza Gilani, former Minister for Law and Justice Dr. Babar Awan briefed the Cabinet about the Constitutional and political situation of the country. He was invited in the Cabinet meeting on a special invitation of the Prime Minister to brief on Constitutional and legal matters. Dr.Babar Awan said that this government has never interfered in the matters of the judicial and essential services posting, transfers and appointments. 'The government can neither appoint nor can dismiss a judge of a Constitutional court through a notification except the mechanism given in various Articles of the Constitution, he said. He told the Cabinet that the government would uphold the rule of law and separation of powers of executive from the judiciary and will ensure that the State institutions must act in accordance with the Constitutional laws and within the given framework. He also explained the details of the judgements of the Supreme Court delivered regarding the privatisation, power projects, sugar price-hike, NICL scam, NRO, NAB and appointment of ad hoc judges, and removal of the PCO judges. He said that the present government, for the first time in the history of the country, has implemented 100 per cent judgments of the apex court. He also briefed the Cabinet about the powers and responsibilities of different institutions of the State. Former Law Minister apprised the Cabinet of grievances sent, in writing, by the Chief Minister of Gilgit-Baltistan Syed Mehdi Shah on the transfer of an officer and said that government of Pakistan promulgated Gilgit-Baltistan Empowerment and Self-governance order, 2009 on September 9th, 2009 whereby people of Gilgit-Baltistan got identity and were granted basic right of self-governance after lapse of 62 years. To meet this urgent requirement of officers, he said, a vacancy sharing formula was reached between Federal government and government of Gilgit-Baltistan whereby it was decided that a committee comprising of Secretary Establishment, Principal Secretary to Prime Minister and Chief Secretary GB will finalise the posting order of police and All Pakistan Unified Grade (APUG) in future. It is clearly laid down that the posting of Chief Secretary and IGP will be made by the Federal government in consultation with Chief Minister and Governor of Gilgit-Baltistan, he added. Later addressing a Press conference, Federal Minister for Information Firdous Ashiq Awan made it clear that government was not heading towards head on collision with judiciary. All institutions have to work following law and Constitution of the country, she said ,adding, that nobody was above the law. To a question about inviting Senator Babar Awan in the Cabinet meeting when Law Minister was also present there, she said that it was prerogative of the Prime Minister as Babar Awan briefed the Cabinet about the Constitutional and political situation of the country. Avoiding other law-related question, she said that a separate briefing will be held soon. 'I have already read out the detailed briefing of the Dr.Babar Awan before media, she added. To another question, she said that incumbent government has completed three and half years and remaining period will also complete smoothly. 'We always respect the institutions and will never allow any conspiracy against judiciary as we will go against all these conspiracies, she added. Talking about agenda items, she said that Cabinet approved Rs 2 billion subsidised price package of essential food items to be distributed through the USC. She said that the Prime Minister stressed all concerned department should ensure adequate supply of necessary household items during the holy month of Ramazan in the markets. The Cabinet discussed and granted ex-post facto approval to the release of financial support of Rs65 billion to PEPCO in order to improve the supply of electricity to the people, she said. The Minister said that the Cabinet discussed and approved the proposed amendments in Pakistan Penal Code 1860 and CPC draft bill, 2011 amending PPC and CrPC, for its introduction in either House of Parliament. The proposed amendments will make the offences like tampering oil & gas pipelines, damaging and causing destruction to oil & gas pipelines and theft of oil & gas liable to punishment of imprisonment and imposition of fine, she added. For the implementation of SC judgment, she said, the Cabinet also discussed the proposed amendments in National Tariff Commission Act 1990. Approval of the Cabinet was also granted for the start of negotiations for finalisation of MoU regarding collaboration in trade promotion activities between trade development authority of Pakistan (TDAP) and India Trade promotion Organisation, she said. The meeting agreed to the signing of MoU on media cooperation exchanges between Pakistan and China, she added. The Cabinet agreed in principle to start negotiations for modernisation and expansion of Pakistan Steel Mills with Russian Federation. It discussed the issues related to equal treatment for contribution in research and development fund for fixed line and mobile operators and decided that 0.5 per cent contribution will be applicable to all the fixed line and mobile phone operators. The Cabinet also reviewed the implementation status of the decisions taken by the Cabinet with regard to the Information Ministry and Interior Ministry.
