LAHORE - The Lahore High Court on Monday restrained Federal government from recovery of taxes under the head of additional surcharge and duty tax on electricity bills with directions to National Energy and Power Regulatory Authority (Nepra) till January 13, 2015.
A Division Bench comprising Justice Syed Mansoor Ali Shah and Justice Ayesha A Malik heard the case.
The petitioner counsel Advocate Azhar Siddique told the bench that the Federal government was collecting taxes under the head of additional surcharge and electricity duty and sales tax..
The petitioner said that the authorities increased taxes in the month of November under the head of Neelum Jehlum Surcharge, DS surcharge and UOF surcharge.
He told the court that Rs 1000 were being collected on bill of Rs 5000.
The petitioner counsel said Nepra had imposed these taxes in violation of its own laws, rules and regulations. He said it was against the fundamental rights of the citizens as well.
After hearing the arguments of the petitioner’s counsel, the bench restrained the Federal government from collecting all taxes under the head of additional surcharge and other duties. The court will resume hearing on Jan 13, 2015.
