Islamabad - Justice Shaukat Aziz Siddiqui of Islamabad High Court yesterday recused himself from hearing a petition seeking release of a man, who is allegedly in the custody of security agencies for killing a prosecutor of Federal Investigation Agency.

A woman on Monday last approached the Islamabad High Court (IHC) and sought release of her husband Muhammad Abdullah Omar, who is allegedly in the custody of security agencies for killing Chaudhary Zulfiqar Ali, former FIA prosecutor.

Justice Siddiqui refused to hear the case saying that he remained a counsel for Abdullah Omar’s father Lt Col Khalid Mehmood Abbasi and morally he feels inappropriate to conduct the hearing of this matter. Now, this petition will be referred to the IHC Chief Justice Muhammad Anwar Khan Kasi to fix it before some other bench.

Abdullah Omar is allegedly involved in two high profile murders in Islamabad including the murder of former federal minister for minority affairs Shehbaz Bhatti and the killing of Ch Zulfiqar Ali, an FIA prosecutor in Benazir Bhutto murder case.

In her petition, Zainab wife of Abdullah Omar has cited SHO Industrial Area, IGP Islamabad, ministry of interior and Inter-Services Intelligence (ISI) as respondents. She has prayed to the court to order the respondents to produce her husband before the court and abolish his custody.

Zainab stated that Abdullah Omar is a son of Lt Col Khalid Mehmood and she married with him on November 10, 2012. She continued that her husband was injured in 2013 in Rawalpindi during a firing incident after which, he was paralyzed and lost his both legs. The incident was reported in Ratta Amral police station of Rawalpindi.

The petitioner added that her husband was at Quaid-e-Azam International Hospital when the respondents took his custody and interrogated him. For a long time, he remained under custody and it was in 2015 when he was released on bail by an anti-terrorism court of Islamabad.

She added that, however, on June 20, 2015, he was abducted allegedly by the officials of security agencies while Hammad Dadan Advocate was also accompanying him. She added that later Hammad was released at the writ petition of his father Mumtaz Anwar.

She contended that this is evident from the said release of Hammad that her husband is also in the custody of ISI. Therefore, she prayed to the court to order her husband’s release.
