ISLAMABAD: Counsel for two dysfunctional judges Justice Shabbar Raza Rizvi and Justice Hasnat Ahmad on Monday filed an intra-court appeal under Section 19 of the Contempt of Court Ordinance, 2003. Dr. Abdul Basit has prayed to the court to set aside February 02, 2011 short order of a four-member bench judgment for initiating contempt proceedings against his clients from next Monday (February 21). A four-member Supreme Court bench headed by Justice Mahmood Akhtar Shahid Siddiqui on February 2, 2011 had announced its verdict on legal point as to whether it could initiate contempt proceedings against the judges who had taken oath under the Provisional Constitution Order in defiance of seven-member benchs restraint order of Nov 3,2007, and whether it could issue contempt notices to generals involved in promulgation of Nov 3, 2007 emergency in the country in defiance of restraint order. Dr Basit also prayed in the intra-court appeal that the notice issued to the appellant on October 5, 2009 be withdrawn forthwith. He contended that the contempt proceedings is likely to erode the authority of the apex court, which is not the intention of the proceeding. It would amount to mis-trial, which needs to be avoided, he further said. Detailed reasons have not been supplied till date, therefore no proper reply to a charge can be made unless detailed reasons are available with adequate opportunity to properly examine them, the counsel argued. He stated that his clients have sought recusal of certain judges of the bench. The petitioners raised a specific plea that Contempt of Court Ordinance 2003 was no longer an existing law and as such any proceeding initiated in accordance therewith were coram-non-judice. Those 9 judges against whom the court would frame contempt charge are: Justice (r) Iftikhar Hussain Chaudhry, Justice (r) Abdul Hameed Dogar and dysfunctional judges including- Justice Hamid Ali Shah, Justice Hasnat Ahmed Khan, Justice Syed Shabbar Raza Rizvi, Justice Yasmin Abbasey, Justice Jehan Zaib Rahim, Justice Sayed Zahid Hussain and Justice Syed Sajjad Hussain Shah. The PCO judges were facing contempt charges for taking oath under the Provisional Constitution Order (PCO) in defiance of a restraining order issued by a seven-judge Supreme Court bench on November 3, 2007.
