LAHORE - Ex-chairman Evacuee Trust Property Board (ETPB), Syed Asif Hashmi, has served a legal notice on current Chairman ETPB, Siddiqul Farooq for levelling baseless charges against him in a recent press conference. The incumbent chairman had addressed a press conference on March 11, wherein, he alleged Asif Hashmi of being involved in irregularities during his tenure. Responding to his press conference, Asif has demanded him to hold another press conference immediately and disclaim his allegations admitting his false allegations within seven days.

His legal notice says, “I have been authorized to sue you in the relevant court of law for the recovery of damages amounting Rs500 million and also to prosecute you in the courts concerned”.

Aish Bahadur Rana, advocate supreme court and counsel of Asif, states in legal notice, “Under the instructions of my client Asif Akhtar Hashmi, Ex-Chairman ETPB, my client is a man of clear antecedents availing good reputation belonging to a well-respected reputed family and led spotless life but was made a scapegoat due to political reasons. You, vide press conference, levelled serious but fictitious and self-thought allegations about my client with all mala-fides, ulterior motives, legal notice further read. Selling of ET lands/properties is being proved from PAC/auditor general of Pakistan, FIA and four other suo-moto cases taken up by Honourable Supreme Court of Pakistan has been dismissed,” it adds.

“Allegation regarding property No SE-36-R-140 and SE-36-R-142 situated at Railway Road Lahore, bearing Khasra No 170-171 being declared as evacuee trust property been shown Khasra No 170/1 (Min) needs demarcation to clarify the fact whether the said property is evacuee trust or not. Its case was never placed before my client as being chairman of ETPB under Section 8 and 10 of the ETP (Management and disposal Act No XIII of 1975 or otherwise) all such cases are dealt-with qua litigation cell which is responsible to maintain the record and to fix the dates of such cases if any act is committed by some elements, then, the remedy lies in the ETP (Management and Disposal act 1975) through reference before the chairman for such declaration. You threatened my client qua forged reference,” the notice further reads.

“The alleged false allegations are to be adjudged by the concerned courts and not by you. You have taken the law in your own hands knowingly that every person is presumed to be innocent until verdict of the concerned court. You adopted yourself as being a judge and caused intuitive, disgracing attitude and acted beyond your authority and merits to be dealt with accordingly,” the notice states.

“My client has serious reservations as a citizen on your picnic inauguration function at Katas Raj Temple by spending more than Rs3 million of national exchequer and other reservations thereto. He has also reservation on your enlistment of a new construction firm namely “Shaheen Construction and Works” for Rs50m and Rs65m being awarded at Katas Raj and Panjja Sahib without allocation of funds in the Fiscal budget 2014-15 and release of some funds and reinstatement of Ghulam Sarwar ADCO (BS-16) without designation and other irregularities not having the authority. My client is moving the NAB authorities for redressal to save the department and the country qua your wrongdoings,” the legal notice concludes.
