ISLAMABAD - The Supreme Court was moved on Monday to dismiss former President General (Retd) Pervez Musharaf’s application for removing his name from the Exit Control List.

A three-member bench, headed by Chief Justice of Pakistan Anwar Zaheer Jamali, will hear Musharraf petition on Tuesday (today) which sough one-time permission to go abroad to undergo surgery for the vertebra fracture to avoid serious complications.

Islamabad High Court on Monday dismissed the former Army Chief’s appeal against the Islamabad Sessions Court, which on February 20 had issued his non-bailable arrest warrant. The session court had also turned down his request for granting him permanent exemption from appearing before the court on medical grounds.

Musharraf has also been summoned by Special Court on March 31 to record his statement under section 342 of CrPc in the high treason case.

Musharraf’s lawyer on Monday also submitted a fresh medical report in the Supreme Court.

Haroon Rashid, son of Ghazi Abdur Rasheed, approached the apex court and prayed to dismiss the application of former military dictator seeking permission to go abroad for a surgery and remove his name from ECL.

The applicant contended that facilities of treatment including surgery of all kinds of diseases are available in Pakistan hence the Federal government may be directed to import that one on emergency basis as the other patients of the same aliment, if any, may also be benefited by it.

He further submitted that Pervez Musharaf has sought permission to go abroad for surgery and four times defied the orders of the Commission constituted by this apex court and then failed to appear before the learned Additional Session Judge Islamabad for 25 times, how it may be expected from him that if allowed to go abroad, he may come back to face his trial in different courts of law.

The petitioner had contended that in the last two years Musharraf has joined over 40 television programmes and attended several functions in which he has been even dancing, but when his date of hearing in the courts draws near, his atmosphere becomes dreary and dismal and he falls sick.

Similarly, the applicant contended that some medical certificates Musharraf annexed with the application seeking permission to go abroad in support of his ailment dated April 26, 2014, May 4, 2014 and the recent one of dated February 25, 2016 whereas those filed before the trial court are different which seems apparently to be fake.

According to the fresh report, the doctors have recommended him to get surgery as soon as possible.

Dr Sohail Rafi, consultant Orthopaedic and Spine Surgeon of Dr Ziauddin Hospital, in his report states that Musharraf was admitted in the hospital on March 13 as he was complaining of severe lower back pain and left leg radiculopathy and numbness.

“He has these episodes frequently for last one month and was admitted twice in another hospital in Karachi. His previous MRI and CT scan show spondylolysis at the level of L5.S1”

There was weakness of grade4+ on the left dorsilflexion of the foot and he has altered sensations on the left foot as compare to the right, adding, that considering his severe pain in the lower back and left legal radiculopathy, we gave him an epidural injection single shot at the level of L5-S1 to reduce level of pain.

The report states that this is a temporary management for his pain but he needs fusion surgery at the level of L5-S1 which was rightly advised by previous doctors involved in his treatment.

“I would recommend him to undergo this surgery & the kind of numbness and slight weakness on the left foot puts him in urgency to get this operation as soon as possible”, the report said.
