IHC serves notice on Pemra secy plea

ISLAMABAD  - The Islamabad High Court (IHC) Thursday issued notices to respondents on a petition of Secretary PEMRA Nasir Ayub seeking vacation of stay orders through which the court had suspended show cause notices issued to three private members of PEMRA.
Justice Noor-ul-Haq N Qureshi issued the notices after the secretary PEMRA moved the IHC to vacate the stay orders.
It was May 26 when the same bench through an interim order had not only suspended the aforesaid show cause notices but had also suspended the appointment notification of Kamal Uddin Tipu as executive member PEMRA.
The Secretary PEMRA had filed a civil miscellaneous application through a deputy attorney general (DAG) Faisal Rafiq Malik for vacation of the orders.
The applicant alleged that the private members of PEMRA Mian Shams, Fareeha Iftikhar and Israr Ahmed Abbasi distorted and concealed the facts and due to the interim order of this court, PEMRA has been facing problems in its functioning that at present is dealing with important matters.
He said that while hearing in the matter of PEMRA’s private members on May 26, the respondents did not have any earlier notice while the requirement of notice under article 199 (4A) of the constitution were thus not met before passing of an interim order. “If the interim orders not vacated/modified/varied PEMRA shall face irreparable loss,” he maintained.
He contended that it is a practice in superior courts of the country that writ against show cause notice not maintainable.
Therefore, he prayed to the court to vacate the stay orders.
