IHC issues notices to law minister, others

ISLAMABAD - A division bench of Islamabad High Court (IHC) comprising Justice Riaz Ahmed Khan and Justice Mohammad Anwar Kasi on Wednesday issued notices to federal law minister, all four provincial law ministers and secretaries, secretary of OEC to submit reply in a petition for abolishing National Industrial Relations Commission (NIRC). Absar ul Haq Satti has filed petition, which was heard by the court on Wednesday. Siam Satti, counsel for the petitioner, informed the court that on April 30,2010 the labour protection law Industrial Relation Ordinance 2008 was abolished. Presently 37.15 million labourers are in the country and they are not having any authority that can address their issues. The counsel argued that Overseas Employment Corporation (OEC) was responsible for the timely action to protect the labour protection ordinance. The counsel requested that court that onward April 30,2010 the salaries, perks and privileges of OEC should be deposited in the national kitty. Until the decision over the fate of OEC their salaries must be stopped. After hearing the arguments court issued the said order. Earlier, the petitioner has mentioned in the petition that in 2002 former president Pervaiz Musharraf issued ordinance for the protection of rights of the labourers, which was later endorsed as law in 2008. However, in the article 87 section 3 it was mentioned that the tenure of ordinance will be ended on April 30,2010. The Parliament did not legislate in this regard. The labour courts, registrar trade unions and National Industrial Relation Commission of Pakistan (NIRC) have lost its validity. Due to this thousand of labourers cases are pending and have deprived of their due rights.
