ISLAMABAD - The Islamabad High Court (IHC) Thursday turned down pre-arrest bail plea of an accused allegedly involved in raping two sisters along with his real brother and other accomplices.
The police instantly arrested the accused person Rafaqat Mehmood after Justice Shaukat Aziz Siddiqui rejected his bail before arrest petition in the rape case.
It is pertinent to mention here that earlier on July 12, 2013, the accused had managed to escape from the court of additional district and sessions judge of Islamabad Rafaqat Awan after dismissal of his bail application. But this time the police took him into custody soon after IHC Justice Shaukat Aziz Siddiqui rejected his pre-arrest bail plea.
According to the investigation report of police, Rafaqat, his brother Shaukat Mehmood, with the help of a taxi driver Abuzar Ghuffari kidnapped two girls namely Ayesha Javed (AJ) 16, and Mariam Javed (MJ) from their house situated in Saidpur village of Islamabad.
The police said that both the girls were alone at their residence on April 9, 2013 as their father Raja Javed had gone to Polyclinic of Islamabad for the routine check-up of his ailing wife.
The police report further stated that the accused persons initially took the girls to a guesthouse situated in sector F-7/4 of Islamabad where they forcibly raped them along with their other accomplices. Then, they took them to Rawalpindi and kept them in a local hotel for couple of days. The police report added that on their way back to Islamabad on April 15, the police intercepted their car at Faizabad check post where the girls told the police officials that the accused persons had abducted them and had raped them against their will.
The police produced the girls before the district magistrate who sent them to Darul Aman and later handed over them to their parents. 
The police recovered the girls from the custody of the accused persons and arrested Shaukat and taxi driver Ghuffari but Rafaqat succeeded to flee from the scene.
Later, the accused Rafaqat filed his pre arrest bail before the additional sessions judge Rafaqat Awan which was rejected on July 12.
In his bail petition, Rafaqat through his counsel Mushtaq Hussain maintained before the court that there was no direct evidence against him that would connect him with the crime.
The counsel said that the police arrested Rafaqat on suspicion and requested the court to accept the bail plea.
On the other hand, Deputy Attorney General (DAG) Tariq Mehmood Jahangiri opposed the bail plea of the accused.
He informed the court that a victim girl has recorded a statement against the accused Rafaqat and her statement was sufficient to prove the crime of the accused person.
According to him, the statement of victim is more than enough in the rape case because it is very difficult for the victim of rape to produce witnesses to verify the allegations.
The court after hearing the arguments dismissed the bail plea of accused Rafaqat.
